FEDERAL HIGH COURT: JONCO PHARMACEUTICAL COMPANY LAWSUIT IS WITHOUT MERIT
Dismissed for lack of diligent prosecution was the disputed Fundamental Human Rights Suit brought by Jonco Pharmaceutical Company Ltd. against the Inspector General of Police, the Police Special Fraud Unit, directed by Commissioner of Police CP Anyasinti Josephine Nneka, and her agents.
The Fundamental Human Rights Enforcement Suit brought by Chief John Njoku of the Jonco Pharmaceutical Company against the Inspector-General of Police, Commissioner of Police (PSFU), CP. Anyasinti Josephine Nneka, and investigators who looked into the case of fraudulent diversion/conversion valued at $223,800,896, and 15 cents was dismissed by Justice I. N. Oweibo of the Federal High Court in Lagos. The court determined that Chief Njoku’s application lacked merit and assessed the applicant with costs totaling 50,000 Naira (N50,000.00).
The Fundamental Rights Suit was filed in response to Chief Njoku’s arrest by the Police Special Fraud Unit (PSFU) for offenses involving the fraudulent conversion or diversion of drugs worth $223,896.15 ($223,896.15) that Gujarat Ligui Pharmacaps of India supplied to his business for distribution or sale.
Initially asserting that the goods had run out before arriving at the ports, Chief John Njoku later backtracked and blamed his inability to send the money from the sale of the goods to his Indian tribe on the weak economy and the strengthening of the US dollar.
